End User License Agreement (EULA)

Version 1.1. This agreement applies to all Tinto Labs apps: Tempo, MiniTray, Pulso and Arcadoro.
This agreement ("License") is between you ("User") and Jairo Alejandro Pinto Garzón, doing business as Tinto Labs ("Licensor"), the author and owner of all rights in the Tinto Labs app you obtained, including its updates, documentation, icons, trademarks and other elements (the "Software"). By downloading, installing, activating or using the Software, you agree to this License. If you do not agree, do not install or use the Software.
1. License grant
Upon a one-time payment of the price, Licensor grants you a worldwide, personal, non-exclusive, non-transferable and perpetual (non-expiring) license to install and use the purchased version of the Software on up to three (3) Mac computers that you own or control, for your personal use or your own professional work. There is no subscription and no recurring payment.
2. Free trial
Before buying, you may use the Software free of charge, with all features, for seven (7) days on each Mac. After the trial, the Software requires a license key to keep working. You may not restart, extend or get around the trial.
3. Updates
All updates within the same major version you purchased (for example, all 1.x releases) are included at no extra cost. A new major version (for example, 2.0) may be offered as a paid upgrade; the version you already purchased will keep working. The Software may automatically check for updates and offer them to you; you decide whether to install them.
4. License key and activation
The Software requires a license key and an online activation for each Mac. You may deactivate a Mac to activate another one within the limit of three (3). Once activated, the Software works offline except for the license and update checks described in the Privacy Policy.
5. Restrictions
You may not: (a) sell, rent, lend, sublicense or redistribute the Software or its key; (b) share your key or use it on more Macs than permitted; (c) circumvent or disable the trial, activation, license protection or updates; (d) decompile, disassemble or reverse engineer the Software, except to the extent applicable law expressly permits it notwithstanding this restriction; (e) remove authorship, trademark or License notices.
6. Ownership
The Software is licensed, not sold. Licensor retains all intellectual and industrial property rights in the Software, its code, name, logo, icons and characters. This License does not transfer to you any right not expressly granted.
7. Third-party components
The Software may include third-party components (for example, open-source components) subject to their own licenses, which are listed within the Software. Those licenses prevail for those components.
8. Privacy
The Software processes your content locally on your Mac and includes no advertising or usage analytics. It connects to the Internet only to start the free trial, activate or check the license, look for updates and — unless you turn it off — send anonymous crash reports, as described in the Privacy Policy.
9. Purchase and refunds
Purchases are processed by an authorized reseller acting as Merchant of Record (currently Lemon Squeezy), whose terms of sale govern payment, taxes and invoicing. You may request a refund within fourteen (14) days of purchase under the Refund Policy. If you receive a refund, this License terminates.
10. No warranty
To the maximum extent permitted by applicable law, the Software is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Licensor does not warrant that the Software is error-free or will operate without interruption.
11. Limitation of liability
To the maximum extent permitted by applicable law, Licensor shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or use. Licensor's total liability shall not exceed the amount you paid for the Software. Nothing in this License excludes or limits liability that cannot be excluded or limited by law.
12. Termination
This License terminates automatically if you breach any of its terms. Upon termination you must stop using the Software and delete it from your computers. Sections 5, 6, 10, 11, 14, 15 and 16 survive termination.
13. Export and sanctions
You agree to comply with applicable export control and sanctions laws, including those of the United States, and not to use or export the Software to countries, entities or persons subject to such restrictions.
14. U.S. Government users
The Software is a "commercial item" and "commercial computer software" as defined in FAR 12.212 and DFARS 227.7202; U.S. Government users receive it only with the rights this License grants to all other users.
15. Consumer rights
This License applies worldwide. Nothing in it limits any rights you have as a consumer under the laws of your country of residence that cannot be waived by contract (for example, in the European Union, the United Kingdom, the United States, Colombia or elsewhere). If any provision is invalid in your jurisdiction, it applies to the extent permitted and the rest remains in effect.
16. Governing law and jurisdiction
This License is governed by the laws of the Republic of Colombia, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. If you are a consumer, you may also bring proceedings in the courts of your country of residence where applicable law guarantees you that right.
17. General
This License is the entire agreement between you and Licensor regarding the Software. Licensor may publish new versions of this License for future versions of the Software; the version you accepted at purchase continues to govern the version you purchased. It is provided in English and Spanish; in case of any discrepancy, the English version prevails. Support and questions about this License: support@tintolabs.com.
